Police were taking 22-year-old Elvin James into custody on attempted murder charges on West 136th Street in Harlem around 4:47 p.m. when the incident happened.
The officers were met by a crowd of people while arresting James, who was found with a loaded ghost gun and drugs at the time of the arrest. Multiple bystanders attempted to intervene, including the 19-year-old woman identified by the Daily News as Tamani Crum, James' girlfriend.
Crum is seen on the video approaching James before Detective Kendo Kinsey punches her, knocking her to the ground.
“You just hit a little girl!” someone can be heard saying in the video. “You’re wilding, bro!”
After being hit by Kinsey, Crum was arrested and charged with assault on a police officer, resisting arrest, and obstructing governmental administration.
Kinsey has been with the NYPD since 2005. He has two substantiated civilian complaints against him filed between 2010 and 2020, according to records.
The NYPD argued that Kinsey’s actions were justified and the incident is being internally reviewed. In a statement to the New York Post, the NYPD said “while police were effecting the arrest multiple individuals on scene interfered by physically assaulting numerous officers. One officer sustained a minor injury to the head.” Paul DiGiacomo, president of the Detective Endowment Association, said in a statement that the organization is looking into suing Crum for attacking Kinsey.
Criminals in New York have grown accustomed to there being no consequences for their dangerous, illegal actions — but when you assault a New York City Detective in order to interfere with an arrest of a man armed with a gun there are repercussions,” DiGiacomo said.
Al Sharpton's National Action Network held a protest Wednesday in front of the 32nd Precinct where Kinsey is based, condemning Kinsey's actions.
