
NEW YORK (1010 WINS) — Police charged a Manhattan parking garage attendant with attempted murder after he was shot Saturday while confronting an alleged thief, then wrested the gun away and opened fire on the suspect, though prosecutors aren't pursuing the case.
Moussa Diarra, 57, was also charged with assault and criminal possession of a weapon after the shooting, which happened around 5:30 a.m. as the attendant saw a man peering into cars on the second floor of the West 31st Street garage, sources told the New York Post.
Believing the man was stealing, Diarra brought him outside and asked what was inside his bag.
Rather than cooperate, the man pulled out a gun, and when Diarra reached for it, it fired, striking him in the stomach and grazing his ear before the attendant turned the gun on the would-be thief and shot him in the chest, the sources said.
Charles Rhodie, the alleged burglar, was also charged with attempted murder, assault, criminal possession of a weapon in addition to burglary, police said.
As of now, the Manhattan district attorney's office said it is not prosecuting the attendant pending a further investigation.
A DA spokesperson told the Daily News that prosecutors are still working out what charges to pursue against Rhodie, 59.
A woman walking by the garage, which is across from Moynihan Train Station, told 1010 WINS that Diarra should be a "hero."
"He saved whoever shot him from shooting someone else," she added.
Both men have been taken to NYC Health + Hospitals/Bellevue for treatment.
