Kim Gardner shut out of McCloskey case by Missouri Supreme Court

ST. LOUIS (KMOX) - The Missouri Supreme Court has denied a request from St. Louis Circuit Attorney Kim Gardner to pursue gun charges against the McCloskeys.

Without explanation, the high court denied Gardner's appeal to be reinstated on the case of Mark and Patricia McCloskey. Lower courts had ruled she had a conflict of interest because she had mentioned the McCloskey case in campaign fundraising emails.

Gardner charged the Central West End couple with unlawful use of a weapon and evidence tampering, after they got their guns and stood on their lawn one night last summer telling protestors to stay back.

Former U.S. Attorney Richard Callahan is expected to serve as a special prosecutor to review the case and decide whether to pursue the charges.
