Ariel James Pennington, 35, was charged after he threatened a flight attendant after he refused to wear a mask and assaulted a federal air marshal.

The flight, which was set to land at Los Angeles, made an emergency landing in Oklahoma City after 7:30 p.m.

Pennington was arrested for disorderly conduct and public drunkenness.

He was indicted on two counts of assaulting a flight attendant and a federal air marshal; however, the second count was dropped following a plea agreement, The Los Angeles Times reported.

Pennington faces up to 20 years in prison and a $250,000 fine, U.S. Attorney Robert Troester said.
