Orange County, Calif. (KNX) - A family is suing Amazon over an accident that killed their two-year-old girl in Orange County last year.

Attorney for The Wu family, Michael Allen, says the tragic event occurred in front of the young girl's 10-year-old brother and their mother, saying it had "catastrophic effects" on the family, community, and surrounding neighbors.

The assertion is that an 18-year-old delivery driver was distracted while on their phone, but when the family asked Amazon to take responsibility, Allen said they refused.

According to Allen's statement at a press conference Friday, Amazon says they are not responsible because they hire a third-party company to handle their drivers and vehicles, which the Wu family should be suing instead.

However, it has been reported that investigators with the Irvine PD have recommended filing charges against the mother rather than the driver.

According to Fox 11, cameras on the Amazon van helped police determine the toddler was left outside alone opening the mother up to criminal charges.

KNX News has called Amazon for a statement but has not heard back.
