Montana has become the first U.S. state to fully ban the social media app TikTok, with Republican Gov. Greg Gianforte signing a measure to take effect on Jan. 1, 2024.

Tech expert Ian Sherr tells KNX News Montana is not penalizing users who have TikTok on their phones, but rather those places offering it.

"The way that they're dealing with this is that they want to kind of stop this at the source," said Sherr, telling Google, Apple, and all app store operators they cannot offer TikTok for download.

Non-compliance could lead to hefty penalties: a $10,000 fine and an additional $10,000 for every day the violation continues.

While many federal and state governments have banned TikTok on government-issued devices, Montana's new law expands the ban to its citizens, stoking a debate on First Amendment rights.

Sherr predicts TikTok will likely challenge this law, and If a compelling case is made arguing that it violates people's rights, a judge may halt the law's implementation until after a court battle.
