Chapman University professor files lawsuit, alleges student posted exam answers on site

ORANGE, Calif. (KNX) – A professor at Chapman University is suing his students who he claimed posted two exams from his Spring 2021 semester class on a document-sharing site.

David Berkovitz, a teacher at George L. Argyros School of Business and Economics, claimed a student – named John Doe - from Berkovitch’s Business 215 class posted two exams on Course Hero, a document-sharing website for students, according to the Orange County Register.

Course Hero is described on its website as “an online learning platform for course-specific study resources.” The site allows students at colleges to upload materials such as study guides and practice problems for certain courses.

Berkovitz discovered the tests on the site in January and in February, he filed a copyright applications for the exams with the United States Copyright Office, which he was granted.

Berkovitz’s lawyer, Marc E. Hankin, told the newspaper that Berkovitz had a warning printed on those tests saying that the tests were not to be copied. Hankin also said uploading the tests were in violation of the school’s honor code.

“It seems to be cheating and an ethical violation of Chapman’s honor code,” he said. “If there is some ethical impropriety going on, we want to stop that because it changes the grading curve.”

Hankin added he intends to subpoena Course Hero as well.
