
An appeals court in Dallas has ruled the families of at least eight victims of convicted killer Billy Chemirmir cannot sue a senior citizen living center without going through arbitration.
In the civil lawsuit, the familes want a jury to decide damages for what they allege was a low standard of security at the retirement center that allowed serial killer Chemirmir to prey on victims.
All eight victims were elderly women who were smothered to death at the Tradition-Prestonwood retirement center.
The appeals court says the victims had previously signed agreements that take disputes before an arbitrator.
Arbitration is a procedure in which a dispute is submitted, by agreement of the parties, to one or more arbitrators who make a binding decision on the dispute. In choosing arbitration, the parties opt for a private dispute resolution procedure instead of going to court.
Billy Chemirmir is already serving one capital murder prison term of life without parole. His second capital murder trial is set for October 3rd. He faces 21 more capital murder cases between Dallas and Collin Counties.
