Governor Abbott this week doubled down on his executive order that there cannot be mandates when it comes to protection against Covid 19.
Houston employment attorney Todd Slobin says Governor Abbott will not back down. That doesn't mean the lawsuits will stop. He says a school district or municipality could file a suit in a federal court and get a friendly ruling. "Then go to the 5th circuit which is very conservative, then you could take it to the Supreme Court, which is primarily Republican. I don't mean to seem like the Grim Reaper, but it doesn't seem like there are a lot of opportunities for any significant change to be made against what Abbott is doing. I think he knows that."
He also notes that there are a lot of politics in the judicial system. "And because of that, right or wrong doesn't always prevail where it should."
The Paris ISD has made masks as part of their dress code. "I love the creativity with that one, and I hope that other school districts use that as a way to get around it, because I think there is always going to be a loophole and I hope it works."
He stresses those trying to impose mask mandates are looking out for their fellow citizens. "They are trying to make sure this virus doesn't pass on to other people. I hope it sticks. But there may be someone at that school or district who doesn't want their son to wear a mask. They could then file their own lawsuit."
