Texas Court of Criminal Appeals upholds capital murder conviction, death sentence for DeSoto man

The Texas Court of Criminal Appeals today upheld the capital murder conviction and death sentence for a DeSoto man who killed a prison guard.

Dillion Gage Compton, 28, was serving a 25-year prison term at the French Robertson prison near Abilene when he killed guard Mari Ann Johnson of Fort Worth.

Prosecutors say Johnson died from blunt force trauma and a crushed throat. Compton was found with scratches on his face and his skin was found underneath Johnson's fingernails.

Reports say the killing occurred while Compton was incarcerated for aggravated sexual assault of a child in a 2010 attack on a Dallas County girl.

A jury in Jones County convicted Compton and imposed the death sentence.

A judge will now set an execution date. Compton can still appeal to the federal court system.
