Woman files appeal in Texas illegal voting case

Attorneys for Crystal Mason have filed a request with the Texas Court of Criminal Appeals to get her conviction for illegal voting overturned.

Mason cast a provisional ballot in Tarrant County in the 2016 presidential election. She was on supervised release from a federal tax fraud conviction at the time. That meant she was not eligible to vote. She was convicted and sentenced to five years in prison.

Her attorneys say that conviction should be overturned because of a provision in the new Texas elections law, Senate Bill 1. That provision stipulates that people should not face punishment for voting illegally if they did not know they were ineligible.

The Tarrant County District Attorney's Office says it presented evidence at trial that Mason did know she was not allowed to vote. They say the new law does not apply to her case.
