
The US Supreme Court today declined to hear the case of a west Texas hotel operator who sued his county judge over COVID restrictions.
The ruling ends the claims by billionaire J.P. Bryan and his company Gage Properties, Inc., owner of the historic Gage Hotel in the Brewster County town of Marathon, just outside the Big Bend National Park.
Bryan had said Brewster County Judge Eleazar Cano violated his civil rights by closing the hotel and other short-term rentals and ordering all guests to leave as the coronavirus pandemic was tightening its grip in March of 2020.
The courts have ruled the Judge was acting within the scope of his job in making the order.
