
CHICAGO (WBBM NEWSRADIO) -- A federal judge has struck down a motion for a temporary vaccine mandate restraining order in an ongoing City of Chicago and State of Illinois employee filed lawsuit.
Among the claims made by the city and state employees in the federal lawsuit is that the vaccine mandates violate constitutional rights and that neither Governor Pritzker nor Mayor Lightfoot have the authority to issue them.
U.S. District Court Judge John Lee at a hearing said he believes the city and state leaders do have that authority. Mayor Lightfoot further backed this week by the city council voted to extend the mandate.
The plaintiffs cited Roe V. Wade as an example of rights over bodily autonomy, but Judge Lee said the Supreme Court ruling does not apply to one individual’s behavior that puts the greater public at risk. Lee also cited that that the mandates were neutral and not targeted of any specific religion.
Judge Lee also said in making his decision to deny a temporary restraining order, that he would need to see potential for the federal lawsuit’s success, which he says with the present information he does not.
