
(WBBM NEWSRADIO) — The deadly shooting of a Wayne man’s dog last year is getting another look.
In September, Kane County State’s Attorney Jamie Mosser said her office would not bring charges against a resident who fatally shot a neighbor’s dog on Aug. 10, 2021. On Monday, Mosser announced she’ll ask a grand jury to reexamine the case after her own review was criticized.
“Although I am in no way bound to revisit this case, I have agreed to do so based on a number of requests regarding the evidence and the law,” she said in a news release. “It is my hope that once the grand jury process is complete, regardless of the outcome, that everyone will abide by the grand jury’s decision and conclude that the process has been fair, neutral and transparent.”
Mosser previously said Hal Phipps feared for his life when a neighbor’s two Dogo Argentinos ran onto his property. Phipps told officer he fired one shot from a .38-caliber pistol, which killed one of the animals.
Questions about the fairness and transparency of the earlier investigation have come from the dog’s owner and supporters of the pet, Mosser said.
