Buffalo, NY (WBEN) The state's mask mandate is the focus of a lawsuit being filed by a local private school. The attorney for the school says every measure was taken to ensure students did not have to wear a mask to start the school year.

Christian Central Academy is suing the state, says Todd Aldinger, after hiring more teachers so each student was six feet apart from each and brought in air purification systems for each classroom. "They spent more than $200,000 to provide significant safety without masks. They also recruited a number of students whose parents felt the masks were impairing their development," says Aldinger.

Aldinger says everything parents were told over the summer were thrown out the window. "We have about 20 to 25 percent of parents threatening to pull their kids out and homeschool them instead because they don't want their kids to go through another year not having normal interpersonal communication and having their education and social development impeded by wearing a mask," says Aldinger, who adds parents feel "the rug's been pulled from under them."

Aldigner says parents feel betrayed by the state when they announced a mask mandate for another year.

A hearing is scheduled for next week to seek a preliminary injunction against the state's mask mandate.
