Meeting scheduled for Sept. 18 between Department of Justice, lawyers in federal case against Tops shooter

Buffalo, N.Y. (WBEN) - Another status conference was held on Wednesday with regards to the federal case against Payton Gendron, the gunman of the Tops mass shooting on May 14, 2022 that killed 10 Black people on Jefferson Avenue in East Buffalo.

During Wednesday's status conference at the Robert H. Jackson United States Courthouse in Downtown Buffalo, the federal case was assigned to District Judge Lawrence Vilardo, who will take over for Magistrate Kenneth Schroeder to handle motions and everything else going forward.

On Monday, Sept. 18, there is scheduled to be a meeting with officials from the Department of Justice, the Western District of New York and the defense counsel to discuss the potential of Gendron facing a trial for the death penalty. It is not expected for a decision to be made at that time whether a trial for the death penalty will be held.

The next status conference between both sides has been scheduled for Friday, Oct. 20.
