
Brooklyn, N.Y. (WBEN) - A legal filing has surfaced linking the owner of the tour bus company involved in Friday’s deadly I-90 crash to prior regulatory troubles in New York State. The legal document, filed by the State Department of Environmental Conservation, outlines penalties and compliance obligations against M&Y Tour Inc. and its owner, Dewen Su.
M&Y Tour Inc. owned the bus that overturned, killing five people and injuring dozens more Friday afternoon on the Thruway near Pembroke. The bus was returning to New York City from Niagara Falls when it crashed.
According to a legal document obtained by WBEN, the company owns property in Brooklyn that was the subject of a 2019 consent order issued by the DEC. The order accused M&Y Tour Inc. and Su of violating environmental regulations at the site, including improper handling, storage and disposal of hazardous waste.
The violations included generating hazardous waste such as automotive fluids and solvents without properly identifying or managing it, storing hazardous waste without a permit, failing to label and contain waste, and failing to maintain required records and manifests used to track hazardous materials.
The company was fined $15,000 and ordered to repair the affected area. Instead of going to court, M&Y Tour Inc. entered into the consent order, a legally binding agreement requiring corrective actions and payment of the penalty. The order, signed by Su, also states the company is fully responsible for compliance and cannot shift liability to employees, contractors or affiliates.
New York State Police and the National Transportation Safety Board continue to investigate the cause of Friday's deadly crash. Authorities have ruled out mechanical failure and operator impairment.
