Second former officer seeks dismissal in Floyd death

Attorney for J Alexander Kueng signs on to motion seeking dismissal of charges

A second former Minneapolis officer involved in the death of George Floyd has filed a motion dismiss the charges against him.

J Alexander Kueng joins Tou Thao following last week's report in the New York Times that officer Derek Chauvin was ready to plead guilty to 3rd degree murder just days after the incident, claiming it will be impossible for them to be afforded due process.

"How are you possibly going to get a jury," wondered local defense attorney Joe Friedberg. "You've got to ask all the potential jurors if they're are aware (of the New York Times story). Now, when you ask if they're aware of it, you've made them aware of it."

Friedberg, who is not involved in the case, was a guest of WCCO's Chad Hartman Tuesday.

The motion also seeks sanctions against Minnesota Attorney General Keith Ellison and other state prosecutors for the leak of information, alleging prosecutorial misconduct.

Ellison has responded Tuesday, calling the claims that his office leaked the information to reporters a "conspiracy theory."
