Attorney for Tou Thao seeks dismissal of charges

Motion also seeks sanctions against Ellison, other prosecutors

One of the former officers charged in connection with George Floyd is seeking to have the case dismissed.

The attorney for Tou Thao has filed a motion to dismiss the charges against his client based on a report in the New York Times last week that Derek Chauvin was ready to plead guilty to 3rd degree murder.

The motion, filed by Thao's attorney Robert Paule, says it's impossible to overstate the damage the report did to Thao's due process.

The motion also seeks sanctions against Minnesota Attorney General Keith Ellison and other state prosecutors for the leak of information.

In response, Ellison says the suggestion that his office leaked information in the case is a "conspiracy theory."
