TROY (WWJ) - A dangerously intoxicated driver who had a pair of open Fireball bottles in his car told police during his arrest that he was texting on his phone when he rear-ended another vehicle in Troy last weekend.

The Troy Police Department said they came into contact with the man shortly after receiving a call for a vehicle crash near the intersection of Maple and Livernois Road at around 11:45 p.m. on June 23.

Officers were advised one of the drivers could be drunk.

When authorities got to the scene, they observed a 2010 Ford Fusion with heavy damage from rear-ending another vehicle. The driver of the Ford, identified as a 36-year-old man from Utica, told police he was texting when the crash occurred.

According to the department, officers noticed the man had trouble speaking and was slurring his words as he talked with them. They noted that he also smelled of alcohol.

The officers put the 36-year-old through a series of sobriety tests, all of which the man did very poorly.

He was evaluated by Alliance Mobile Health and medical cleared from the car crash. The driver then preformed a preliminary breath test which came back with a result of .374%, police said.

The man was arrested and taken to the Troy Police Lock-Up facility,

"During an inventory search of his vehicle, officers located 2 open 100mL bottles of Fireball Whiskey in the center console," police continued. "In lock-up, the driver was read his Chemical Test Rights and he agreed to submit to a breath test with results of .37% and .37%."

The 36-year-old was released to Troy Beaumont Hospital for further medical care due to his high blood alcohol level.

The department said the man was issued a citation for Operating While Intoxicated and Transport Open Intoxicants in a Vehicle.
