
TROY (WWJ) -- A 27-year-old Troy man is facing charges under Michigan's 'Super Drunk Laws' after it's alleged he was found sleeping behind the wheel with an open bottle of booze nearby.
The Troy Police Department responded at around 4:30 a.m. on Sunday, March 12, to a report of a man who was slumped over the steering wheel of a vehicle that was running, with loud music playing, stopped in the area of Pond Ridge and Village Park Drive.
When officers arrived on the scene and spoke with the man, they "noted there was a strong odor of alcohol emanating from his person," according to the police report.
The man was asked to perform some sobriety evaluations, and he did but preformed poorly, police said.
Officers got permission from the man to search the car, and found an open bottle of tequila on the passenger seat.
The driver then refused to take a breathalyzer test at the scene and was arrested.
Later, at the Troy Police Lock-Up, police said the man agreed to take a chemical breath test with results of .20%. and .19%
He was issued a citation for Operating a Motor Vehicle with a Blood Alcohol Content Above 0.17%, and Transporting Open Intoxicants.
Under the state's 'Super Drunk Laws,' drivers with a BAC more than twice the legal limit of .08% face stiffer penalties, including up to 180 days in jail.
The man's name was not released.
