HARTFORD, Conn. (1010 WINS) -- A Connecticut judge dropped the murder and kidnapping charges on Tuesday against Fotis Dulos who died by suicide last month.
The judge sided against his attorney, who wished to pursue a trial in order to clear his name.
Dulos, 52, a Connecticut real estate developer faced capital murder, murder and kidnapping charges in connection after the May 2019 disappearance of his estranged wife, Jennifer Dulos.
Her body has never been found.
Fotis and Jennifer had five children together and were in a were in a contentious child custody battle when she disappeared.
The charges against Dulos were dropped because there can't be a trial without a defendant, the judge alleges.
Dulos' attorney, Norm Pattis, argued that his estate has the right to prove he did not kill his wife and will pursue an appeal through probate court.
