‘Humiliated’ man sues Popeye’s after failed quest to get popular chicken sandwich

NEW YORK (1010 WINS) – Some people are REALLY upset about not getting their limited time Popeye's chicken sandwich, and now one man is even suing the company over it.

Craig Barr of Chattanooga, Tennessee, is suing Popeye’s for $5,000 in damages.

Barr says he couldn’t get his hands on the popular sandwich despite multiple attempts.

He says he's suing for “countless time wasted driving to and from Popeye’s. No chicken sandwich. Was told to come back this day—still no sandwich. Was hustled out of money by an employee.”

According to the lawsuit, Barr drove to multiple Popeye’s, but they were all out of the sandwich.

The lawsuit says he was "attacked" and suffered tire and car damage. He said he was also scammed by a Craigslist ad in which someone claimed to have a hidden stash of the chicken sandwiches.

He said he's now been left humiliated because “friends laughed at me.” 

He's now accusing the company of "false advertising, deceptive business practices."

Popeye’s told ABC News that “the demand for the new Chicken Sandwich in the first few weeks following launch far exceeded our very optimistic expectations.”

The company said it has already sold through its inventory that was expected to last through September but that they’re “working tirelessly to bring the new sandwich back to guests as soon as possible.”

A court date has been set for October.
