FDNY say Waisbren was stuck between elevator car and the shaft wall on the first floor of the building on 3rd Avenue near East 25th Street in Kip's Bay just before 8:30 a.m.

Police say Waisbren was the last person to get out of the elevator on the main floor when it continued going downward and trapped him.

The door remained open, leaving a space where he attempted to get out of but elevator then started again, and crushed him.

Other passengers were safely rescued from the stuck elevator.
