Marvel sends cease and desist letter telling NYC councilman to stop campaigning as Captain America

NEW YORK (1010 WINS) -- Marvel is telling one local lawmaker: You're no superhero.

Marvel Comics sent NYC Councilman Ben Kallos a cease and desist letter after his campaign sent out an email on Friday showing him dressed as Captain America and asking for donations.

The email also featured Kallos borrowing Captain America's trademark phrase, "I can do this all day."

Kallos dresses as Captain America every Halloween at the Roosevelt Island Halloween parade and his campaign staff thought it would be fun to share pictures of him.

"I said sure, it seems pretty tongue-and cheek. I'm clearly not Captain America but sure why not?,"Kallos told 1010 WINS' reporter Sonia Rincon. "And we sent it out. I think my supporters got a kick out of it. And then I got this letter from Marvel and that gave me a kick too."

In the cease and desist letter, Eli Bard, chief counsel for Marvel said, "I write to request that your campaign refrain from using Marvel's characters in its advertisements for your quest for the Borough Presidency or otherwise. While Marvel appreciates your obvious affection for our properties and welcome your support as a fan, we ask that our characters not be used for political purposes or to support political campaigns."

Kallos sent that letter in a tweet to his followers, saying he got this charming letter from Marvel and "got a kick out of it and thought you might too."

Kallos is running for Manhattan Borough President. It's unclear if he'll campaign as the comic superhero ever again.
