LI DJ who smoked pot in Capitol riot sentenced to 3+ years in prison

FARMINGDALE, N.Y. (1010 WINS) – A DJ from Long Island who smoked marijuana in the U.S. Capitol during the January 2021 riot was sentenced to more than three years in prison for assaulting law enforcement officers and other offenses.

The Farmingdale man, Greg Rubenacker, 26, was among those who celebrated the storming of the Capitol by smoking a joint in the Rotunda, according to prosecutors.

Rubenacker confronted officers inside the Capitol around 2:13 p.m. on Jan. 6, according to prosecutors.

Rubenacker recorded a video where he enters the Capitol building through the Senate Wing Door and says, “This is history! We took the Capitol.” The crowd around him yelled, “where are they counting the votes” and eventually ran towards a U.S. Capitol Police officer securing the area, according to prosecutors.

Rubenacker left the building at 2:21 p.m. but came back about 20 minutes later through the Rotunda door where he smoked marijuana as seen in the video. He later posted it on social media with the caption, “Smoke out the Capitol, baby.”

He later resisted officers trying to clear the Rotunda. At around 3 p.m., he threw a plastic bottle at an officer and sprayed water from his bottle at cops, according to prosecutors.

Following his prison term, Rubenacker will be placed on three years of supervised release. He also must pay $2,000 in restitution.

More than 800 individuals have been arrested in connection to the Jan. 6, Capitol siege.
