Alleged gang leader charged with murder for drive-by shooting on LI that killed Bronx teacher

NEW YORK (1010 WINS/WCBS 880) – An alleged gang leader and a juvenile co-defendant were indicted on Friday for a drive-by shooting on Long Island that killed a Bronx elementary school teacher, prosecutors said.

Oumar Barry,  27, an alleged member of the Blood Hound Brims, allegedly shot and killed 44-year-old Kimberly Midgette during an April drive-by shooting while she was in her car with her 10-year-old child in the back seat in Hempstead, according to the indictment.


"Kimberly Midgette was a beloved elementary school teacher at a public school in the Bronx and mother to a 10-year-old daughter," Nassau County District Attorney Anne T. Donnelly said. "Her light was cruelly stolen from all those who cherished her when a hail of bullets entered her vehicle and killed her, and struck her friend."

On April 1, Midgette pulled her Toyota Corolla in front of the home of her ex-husband to drop off her kid for the weekend.

Midgette was in the front seat with a friend in the passenger side and with her daughter in the back seat. Before they left the car, a stolen black Honda Accord driving past them fired multiple rounds of shots and one of them struck Midgette in the face and struck her friend in the arm.

The child was unharmed.

Prosecutors believe that Midgette was not the intended target of the shooting.

Barry was arrested on Nov.  2,  in Hempstead by the Nassau County Police.
Barry was arraigned on grand jury indictment charges of murder, attempted murder, assault, criminal possession of a weapon.

Barry pleaded not guilty and was remanded. He is due back in court on Jan. 23, 2024. If convicted, the defendant faces up to 25 years to life in prison.

A juvenile co-defendant was also indicted and arraigned on Dec. 7, on the same charges.
