NEW YORK (1010 WINS) – Police arrested a Brooklyn man late Tuesday in connection with a confrontation Monday that ended in the fatal shooting of a retired NYPD officer.

Michael Soto, 33, was charged with manslaughter, criminally negligent homicide and assault, police said.

Soto was also shot and wounded during the altercation outside a pizzeria at E. 3rd Street and Church Avenue in Kensington on Monday evening, according to police.

Police said Soto got into an argument with an 86-year-old man inside the pizza shop around 7:15 p.m.

The 57-year-old retired NYPD officer and a 53-year-old retired correction officer tried to intervene on behalf of the 86-year-old, Deputy Chief Joseph Gulotta told reporters Monday.

The dispute moved outside, and at some point, the retired correction officer drew his gun. He fired one shot, striking Soto in the arm and the retired NYPD officer in the chest, according to police.

"During the course of the struggle, which moved down the block, the 53-year-old male pulled out his firearm and one round, we believe, was discharged, striking both victims," Gulotta said.

Both gunshot victims were taken to Maimonides Medical Center, where the retired officer, identified as Thomas Marrinan, was pronounced dead. Soto was in stable condition, police said.
