NEW YORK (1010 WINS) – A 33-year-old man was indicted Thursday for an unprovoked attack on an MTA worker, who he sucker punched at a Midtown subway station last month, the Manhattan D.A.'s Office said.

Robert Ray faces a charge of second-degree assault for the attack at the Lexington Avenue/53rd Street E and M station on the morning of Sept. 16.


The MTA station agent was working around 6 a.m. when Ray followed her as she walked to the bathroom and to check on the functionality of the escalators, prosecutors said.

At some point, he ran up behind her and punched her in the face, causing her to fall to the ground, according to prosecutors.

He allegedly fled the scene but was taken into custody later that day by police.

The victim suffered a laceration, swelling and substantial pain to her face.

Manhattan D.A. Alvin Bragg credited the NYPD for quickly apprehending Ray.

"Millions of New Yorkers rely on the hard work of our dedicated MTA employees every day, and we will continue to work closely with our law enforcement partners to ensure our transit system is safe," Bragg said in a statement. "I hope the victim continues to heal from this assault."
