Errol Oskay, a 36-year-old from Sackets Harbor, now faces a felony charge for falsifying business records and a misdemeanor for petit larceny.
Oskay bought the toy from the Walmart in Watertown on Monday and returned it the next day, according to authorities.
Walmart asset protection told police they discovered a beat-up older model of the toy inside, indicating Oskay stole the new model as a replacement.
The officer was suspended while an internal investigation is carried out. State police did not say whether he will continue to be paid during his suspension.
Police issued the officer an appearance ticket. His first court date is slated for Oct. 3 in Watertown.
