Joseph San Filippo, a 39-year-old traffic enforcement agent, was pulled over on the West Shore Expressway near South Avenue on Staten Island at around 3:17 a.m., authorities say.

The officer who pulled him over claims he smelled alcohol on San Filippo’s breath, but the traffic agent refused to take a breathalyzer test.

The police charged him with driving while intoxicated and refusal to take a breath test.

A police officer noticed Riyad Baksh, a 26-year-old EMT, swerving out of his lane and pulled him over near the intersection of Bay Parkway and Shore Parkway in Brooklyn, according to the NYPD.

Baksh took a breathalyzer test and blew above the legal limit of .08, say authorities.

He was charged with driving while intoxicated and failure to use the designated lane.
