An Indiana man is facing felony charges after he was shot in the back by a 2-year-old boy who found a gun.
Police found Justin Wiley suffering from a gunshot wound in the middle of his upper back on Sept. 9, according to a probable cause affidavit obtained by The Journal Gazette.
The shooting happened at the home of a woman who has an active protection order against Wiley, police noted.
Wiley told investigators that he put the gun on a bed before the 2-year-old boy grabbed it and pulled the trigger. The woman also told police she heard the gunshot, followed by Wiley yelling "He shot me," The Gazette reported.
The child had swelling and blistering injuries to his right pointer finger, which also had signs of gunpowder, according to the report.
Wiley, who is not legally allowed to carry a gun because of prior felony convictions, is facing charges of unlawful possession of a handgun in addition to neglect. He remains free on bond, The Gazette reported.
