(WWJ) – A Michigan Court of Claims judge on Tuesday ruled that former President Donald Trump can remain on Michigan’s presidential primary ballot next year.
Judge James Robert Redford heard arguments last week on three lawsuits — two looking to have Secretary of State Jocelyn Benson keep Trump’s name off the ballot and one looking to block that from happening — before issuing opinions on Tuesday afternoon.
In two of the cases, Redford rejected arguments that the courts or Benson have the authority to keep Trump off the ballot. Redford said it would be "inappropriate" to deem Trump ineligible for the ballot.
Activist Robert Davis brought the lawsuit saying a section of the U.S. Constitution’s 14th Amendment prohibits a person from running for federal office if they have engaged in insurrection or rebellion against the U.S. or given aid or comfort to those who have.
An appeal in the case is likely.
