(KFTK) – Hans von Spakovsky joins Marc and says there are challenges to absentee and mail-in ballots in the upcoming November election.
"These kind of litigation fights are going on all over the country and we're getting all kinds of mixed results from judges," says Spakovsky. "There's like 160 lawsuits that have been filed, a few of them by the President and the RNC, but almost all of them exclusively by the other side of the political aisle. Its because of fights over absentee and mail-in ballots.
Spakovsky says since election law is generally a state issue, he expects the Federal courts to defer to their rulings.
Spakovsly finds it ironic to see a new article on the 1864 election in the Washington Post.
"Now everybody wants to go back to massive absentee balloting, well the first time it ever happened in a Presidential election (in 1864), they tried to steal the election that way," says Heritage's Hans von Spakovsky.
