When the Chief Justice switched sides and upheld Obamacare, he did it by declaring the ‘penalty’ a ‘tax’.
Spakovsky maintains that since the penalty (or tax) has since been removed, the legislation is now unconstitutional.
This is only one of many cases that the current eight justices will be overseeing.
