Colorado woman will avoid jail after getting pregnant with 13-year-old's baby

A Colorado woman will avoid jail time as part of a plea deal after admitting to a sexual encounter with an underage teen and becoming pregnant with his child.

Andrea Serrano, 31, was arrested in 2022 on sexual assault charges after engaging in intercourse with a 13-year-old boy.

“I feel like my son is robbed of his childhood,” the victim’s mother said, according to CNN. “Now he's having to be a father. He's a victim, and he's going to have to live with that for the rest of his life.”

She added that her son is having trouble coming to grips with the gravity of the consequences of his assault, and she lamented the perceived leniency being afforded Serrano.

“It has caused him a lot of depression. He has shut down a lot,” she said. “I feel like if she was a man and he was a little girl, it would definitely be different. They would be seeking incarceration and I feel that because she’s a woman they are not. They are having compassion for her because she’s pregnant, but… that child was created from a sexual abuse.”

Serrano’s plea deal requires that she register as a sex offender, and she’s facing 10 years to life on sex offender intensive supervised probation at the judge’s discretion.

But as part of the plea, the district attorney’s office adapted the indictment to lesser charges that don’t include mandatory jail time.

The family of the victim said they will seek custody of the child be given to their son.
