Illinois father wins lawsuit against daughter's school after order to quarantine

After his daughter was ordered to quarantine by her school, an Illinois father took action. Vince Deichmann’s court date was on Monday, and he was able to walk away victorious. After his daughter was removed from class, Deichmann lawyered up.

“We were made aware of our rights and moved forward with it,” says Deichmann.


Tom Devore, the attorney who took the case, breaks down the reasoning behind their victory.

“The legislature specifically says that the right of a student to an education includes a minimum number of in person learning education days that can only be taken away from a child in a manner described by law,” says Devore. “Schools don’t get to circumvent due process.”

According to Devore, it’s become increasingly common for schools to take actions akin to what happened in this case.

“School districts are becoming so emboldened that they’re doing it on their own and not even involving the Department of Health.”
