WASHINGTON (KMOX) - Sen. Josh Hawley is calling on the U.S. Supreme Court to overturn the landmark ruling that legalized abortion nationwide.
The Missouri Republican and fellow GOP Senators Mike Lee and Ted Cruz filed a brief on Monday with the nation's highest court arguing the Roe v. Wade decision should be thrown out. They want the abortion law to be determined by each state.
The state of Missouri would be able to enforce one of the nation's most restrictive abortion laws if Roe v Wade is overturned.
"Its existence constitutes an open invitation to judges to interpret it according to their own policy preferences, usurping the constitutional prerogatives of the legislature. Roe and Casey should be overruled, and the question of abortion legislation should be returned to the states,” the senators stated in a press release.
