Mask mandates are popping up all over the country again, but after months of new data, vaccines, new cases natural immunity, many are wondering if another mask mandate is really beneficial and if it’s something that governments can even enforce.
Illinois Governor J.B. Pritzker is one such politician under scrutiny from Illinoisans who feel their civil liberties are being threatened unlawfully.
“The governor has gone off on a tyrannical bend; shame, blame, threaten, coerce,” says Illinois State Representative Blaine Wilhour.
Wilhour says that while the Governor has some powers within his executive authority, he still needs to cite valid statutes in Illinois law to support any regulations he puts in place. Currently, Gov. Pritzker is citing Section 11 of the Illinois Constitution and, more specifically, the Illinois Emergency Management Agency Act. According to Wilhour, neither contain any specific support for the Governor’s mandate.
“The important thing about that Act is it contains no enforcement mechanisms,” Wilhour says. “The Act does not specifically give the governor the author to create new regulations.”
