7.12.22 Dr. Miles – Pregnant woman fights ticket she got driving in HOV lane

Brandy Bottone was driving through Plano when she received a ticket for driving in the HOV lane.  Officers noted that she was driving by herself and therefore in violation of the law.

However, Bottone claims she did have another passenger in her vehicle, her unborn child.


Battone described the encounter in an interview with CNN Sunday, "He said, 'Is there somebody else in the car?' And, looking around, I said, 'Yes there is,' and he said 'Well, where?' I pointed at my stomach and I was like, 'Right here.'"

"He said, 'Well, it's two bodies outside of the body, so that doesn't count.' I was kind of in shock, and I was like, 'Well, in light of everything that's happened, and I'm not trying to make a huge political stance here, but do you understand that this is a baby?'"

Unfortunately, Battone's reasoning did not resonate with the officers at the scene.

She said, "He kind of just brushed me off and asked me to go to the other officer to get my citation."  The other officer told her similar things though added, "Honestly if you go and fight this I'm sure it'll get dropped."

Does this woman have a point, though?  According to the letter of the law, her unborn child is considered a person.  So shouldn't that logic apply to all aspects of life?
