McSwain was killed November 3rd, when he was hit by a box truck while riding his bicycle. The crash happened on Highway 150 near Northgate Road in Cherokee County. McSwain's family reported him missing February 13th.

Fowler's report says McSwain did not have ID on him when he was killed and there was no public response to efforts by his office and the Highway Patrol to identity him. The report says McSwain was known to live in the woods and not come home for months at a time.
