No charges in "justifiable homicide"

No charges will be in the case of an argument that erupted into a fatal gunfight at a Spartanburg convenience store last month.

Spartanburg police say witnesses and evidence agree that a man on a moped fired first in a confrontation with four people in a car at a Spinx station the night of July 9th.


The argument started in a parking lot on John B White Sr Boulevard near Reidville Road.  The police report doesn't say that it was about, but the four men in rthe car told officers the moped rider --- later identified as 26-year-old David Nickolitich Pugach of Spartanburg -- started hitting one of them, then pulled a gun and started shooting when the others came to his rescue.

One of the men in the car was shot in chest -- he underwent emergency surgery -- another one hit in back, his wound described as non-life-threatening.

That's when their companion shot Pugach who ran from the scene.  He was later found dead near east Bkackstock Road, a victim, investigators say, of justifiable homicide.
