(1010 WINS) -- "Empire" has been renewed for a sixth season, but it looks like Jussie Smollet won't be returning.
"By mutual agreement, the studio has negotiated an extension to Jussie Smollett's option for season six, but at this time there are no plans for the character of Jamal to return to 'Empire,'" Fox Entertainment and 20th Century Fox Television said in a statement.
Earlier this year, Smollett claimed he was attacked on a Chicago street in a racist and homophobic attack. Although the criminal charges were dropped and he has maintained his innocence, the city of Chicago has sued him to recoup the costs associated with the investigation.
