Foie Gras On The Menu Again In California After Court Ruling

Foie gras is back on California menus following a judge's ruling the dish can't be prevented from being transported in from out of state.

California's controversial ban on the rich delicacy was challenged by out-of-state producers. An appeals court had previously upheld the ban, but a judge Tuesday ruled for the plaintiffs, including farmers located in Canada and New York.


The judge said the sale of foie gras - the fattened liver of a duck or goose - doesn't violate California law if the seller is located outside of the state. The product must be given to a third-party delivery service and brought into the state.

Farmers who produce foie gras contend the birds are treated humanely and don't suffer during the fattening process.

Last year, New York City prohibited restaurants and grocery stores from selling foie gras starting in 2022, calling for a fine of up to $2,000 for each violation.

Chicago banned it in 2006, but the ordinance was repealed two years later.
