3 charged in attempted robbery, shooting of former Oakland police captain

Authorities have filed charges against three suspects in connection with the shooting and attempted robbery of a former Oakland police captain at a gas station in West Oakland last month.

The suspects also face charges in connection with the death of a fourth suspect, a complaint filed last Wednesday said.

Kemandre King, Marlon King and Joshua Hayles have all been charged in the murder of 20-year-old Desoni Djuan Lamar Gardner of Vallejo, plus second-degree robbery stemming from the attempted robbery and shooting of ex-captain Ersie Joyner on Oct. 21. Both Marlon King and Kemandre King were additionally charged with assault with a semiautomatic firearm.

Marlon King also faces a charge of premeditated attempted murder.

The incident happened at a gas station on the 1700 block of Castro St. where Joyner was filling up his white Porsche. Three people drove up in a black sedan and approached Joyner "at gunpoint, threatening to shoot him, and stole his property," the Alameda County District Attorney's Office said.

Joyner fired multiple shots back at his assailants, two of whom were injured and one of whom – Gardner – eventually died from gunshot wounds at the scene. Joyner then approached the suspects' vehicle, and was shot multiple times. The remaining two individuals fled the scene.

Joyner, originally listed in critical condition, was treated for his injuries at Highland Hospital and released last week.

"Ersie Joyner was senselessly attacked and shot while being robbed," Alameda County District Attorney Nancy O'Malley in a statement. "We continue to pray for his full recovery. Our thoughts are with him and his family."

Hayes was arrested in Houston, Texas. He's being extradited to California.

Marlon King and Kemandre King were arrested in Elk Grove and arraigned on Tuesday at the East County Hall of Justice in Dublin.

"We appreciate all the hard work that went into this investigation as well as the information that was brought to us by community members as we've called for help from our community," Armstrong said at a press briefing on Monday. Armstrong previously said police didn't have reason to believe "at this time" that Joyner was targeted based upon his current or previous work.
