A juror from the Scott Peterson trial 20-years-ago takes the stand once again in a San Mateo County courtroom testifying to determine whether the convicted murderer gets a new trial.

The juror called "Strawberry Shortcake" at the time known for her bright red hair is testifying in this evidentiary hearing with immunity. Richelle Nice now has brown hair and was walked through her declaration page by Scott Peterson’s attorney. She said she was honest when she claimed she was not a victim of a crime according to her definition.
"The defense does not need to prove that Richelle Nice committed perjury," legal analyst Steven Clark said. "What they need to show is that her lack of candor in the jury selection process caused Scott Peterson not to get a fair trial."
Scott Peterson was convicted of killing his pregnant wife Laci and their unborn child. Nice failed to disclose during jury selection that she sought out a restraining order while pregnant, fearing for her unborn child because of threats from her boyfriend's ex-girlfriend. She also failed to disclose that her boyfriend beat her during the selection process.
"Well it is a tough hurdle for the defense I mean this is a 20-year-old case, but when you think about the issues that this juror was discussing domestic violence she engaged in, getting a prior restraining order those go right to the heart of the defense," Clark explained.
In December Peterson's sentence was overturned to be life without parole instead of the death penalty. This is about getting a new trial with defense hopes of overturning the guilty verdict.
