San Jose police arrest serial pellet shooting suspect

SAN JOSE (KCBS RADIO) – A serial pellet gun shooter has been apprehended, according to San Jose police.

Nicholas Montoya, 38, has been accused of committing multiple separate assaults with a deadly weapon in multiple locations in San Jose.

On June 10, the day of the first assaults, three victims were struck with a lead pellet fired from a high-powered air rifle. The attacks spanned just 45 minutes. The next day, another victim was shot with a pellet.

As police began investigating the attacks, three more incidents were discovered to have been committed between April 14 and June 15.

In all seven of the assaults, the victims were struck with high-velocity projectiles believed to be pellets. In subsequent treatment for their injuries, some wound up being unable to get the pellets removed to avoid surgical risks. The victims ranged from as young as 9 years old to 56 years old. One, a 15-year-old girl, Gianna Vitarelli, suffered a collapsed lung due to the injury, and is one of the victims who wasn’t able to get the pellet removed.

Six out of the seven victims were women, and six of the shootings occurred in San Jose with one in Campbell.

Due to a collaboration between multiple South Bay law enforcement agencies, Montoya was identified as a suspect in the shootings and on Tuesday he was arrested by San Jose Police at his home in the 200 block of Beverly Court in the City of Campbell.

He is being charged with seven counts of assault with a deadly weapon and assault causing great bodily injury.
