Police arrest teen trio, 11-year-old in SF beating of elderly Asian woman

SAN FRANCISCO (KCBS RADIO) – Three teens and an 11-year-old have been arrested in the San Francisco assault of a 70-year-old Asian woman last month.

The San Francisco Police Department announced on Monday that Darryl Moore, an 18-year-old Oakland resident, a 14-year-old, a 13-year-old and an 11-year-old had been arrested in connection to the beating. Security footage KGO obtained earlier this month showed four people kicking the woman in the head multiple times after she was dragged to the ground.

Moore, the 14- and 13-year-old are facing charges of robbery, elder abuse, burglary, false imprisonment and conspiracy. The 18-year-old is being held on $50,000 bail in the San Francisco County Jail, according to sheriff's office records, with no court date listed.

The other teenagers will face charges in juvenile court, while the 11-year-old will not be charged on account of their age. Former California Gov. Jerry Brown signed into law a 2018 bill barring prosecution of children under 12 years old except when facing allegations of murder or forcible rape.

"With the 11-year-old, that's gonna be a community issue because he's too young to be charged with a crime," San Francisco District Attorney Brooke Jenkins said in a press conference on Monday. "And, obviously, there are concerns about the type of guidance that is in his life given the fact that he was being taken out to engage in this type of behavior."

Jenkins told the San Francisco Chronicle's editorial board last month that she "generally" opposes charging minors as adults after previously saying prosecutors should have discretion to do so. Chesa Boudin, her recalled predecessor, barred the office from doing so.

The woman told police that four people followed her into a building on the afternoon of July 31. They initially approached her outside of the building, she said, but the 70-year-old couldn’t understand them due to "a language barrier," according to police. The group attacked her inside of the building, and she told KGO that the group took her keys.

Milpitas police detained Moore, the 13- and 11-year-old in a theft investigation at the Great Mall of the Bay Area on Aug. 10.

A Milpitas Police Department spokesperson told KCBS Radio in an emailed statement on Monday night that officers booked Moore into Santa Clara County Jail on a felony warrant related to the San Francisco assault. Moore was booked in San Francisco three days after his arrest in Milpitas, according to sheriff’s office records. Milpitas police said he doesn’t face any additional charges in the theft investigation.

Officers booked one of the minors into Santa Clara County Juvenile Hall, while the other was placed into Santa Clara County Department of Family and Children’s Services custody. The Milpitas police spokesperson didn't say which of the minors was in custody with which department.

Last month's attack is among the latest to target an Asian American victim in the city. San Francisco Police Chief Bill Scott called it "a senseless act of violence against the Asian community" during Monday's press conference, and Jenkins said her office's investigation will determine whether or not prosecutors will pursue hate crime enhancements to the charges.
