5 Texas women sue the state over abortion restriction laws

SAN FRANCISCO (KCBS RADIO) – A group of women who were denied abortions is suing Texas to clarify exceptions to the laws.

Many doctors in the Lone Star state are opting not to perform any abortions for fear of jail time or losing their medical licenses.

The lawsuit has been brought by five women who are all Texas residents.

"Just sort of soul-crushing to read the complaint where people with wanted pregnancies are being left to bleed and risk infection and suffer innumerable other ways," said Joanna Grossman, a law professor at Southern Methodist University in Dallas.

"And no one will help them because they're afraid of criminal liability under these bans," she said.

"If you perform an abortion and then some prosecutor decides you've overstepped, in Texas the risk is 99 years in prison and loss of your medical license," said Grossman.

It's possible that the women get relief at the trial court level but as you go up the court system in Texas, things become more conservative.

"It's a very powerful complaint, I think they raised some good legal issues but it is sort of a novel claim, in some ways," she said.

The Texas Supreme Court has ruled in favor of Texas abortion restrictions in previous disputes.
