Former President Donald Trump may be the frontrunner to become the GOP presidential candidate in 2024, but his name may not appear on ballots in at least one state when it comes time to vote in the primary.

A majority of the Colorado Supreme Court decided Tuesday that the former president should be disqualified from holding office under Section Three of the Fourteenth Amendment and said the lower court ruling would be stayed through Jan. 4, 2024. That section bars anyone who swore an oath to the Constitution and then participated in an insurrection against it from holding office.

Trump has faced a mountain of legal trouble this year, including being indicted over his role in the Jan. 6, 2021 Capitol Riot insurrection.

CNN called the Colorado Supreme Court’s ruling a “stunning decision” and it reported that the “Trump campaign said it would swiftly file an appeal and described the ruling as “a completely flawed decision.”

Trump himself often takes to Truth Social to comment on decisions such as this one, but he had not as of 7:30 p.m. ET Tuesday. Earlier in the day he referenced “Deranged Jack Smith,” the special counsel who brought charges against him related to the Capitol riot.
